Planning Appeals – High Court

High Court appeals or applications concerning a decision of the Secretary of State (or one of his appointed Inspectors) can be made only on a point of law. Examples of this litigation include challenges to a refusal to grant planning permission, challenges to the upholding of an enforcement notice, challenges to a refusal to issue a lawful development certificate, and challenges to an award of costs following a planning inquiry.

Much of the High Court work of members of 4-5 involves advising clients on or representing clients in appeals and applications of this kind, and 4-5 is one of very few chambers specialising in this work. Hearings take place at the High Court in London or at one of the regional Administrative Courts (Birmingham, Cardiff, Leeds or Manchester). Many members of chambers are accredited to the public access scheme, and so may be instructed direct by the client without the need for a solicitor or other professional intermediary.
