Adult Social Care

Adult social care law is a growing discipline, due in large part to the increasing volume of legislation governing the topic and the growing demand for social care with an ageing population. The law and policy in the area affects many, including local authorities and NHS bodies, providers of care and the individuals who seek care and their carers.

We undertake work across the full range of local authority community care functions. Our work includes advice and representation in respect of individuals as well as dealing with matters of policy and disputes about corporate decisions relating to social care. Members appear in the Court of Protection, the High Court’s inherent jurisdiction and in judicial review proceedings. A number of members have been instructed high profile cases concerning the funding of care services, including challenges to care home fees, and other challenges to budget reduction decisions.

Our expertise in community care law is complimented by experience in the fields of healthcare law, public law, human rights and the law of education. As well as public law work in this area, Chambers’ expertise in the fields of commercial disputes and regulatory law allow us to offer a full service to the providers of care.
