Dr Ami Barav has been instructed by FIFA

Dr Ami Barav of 4-5 Gray’s Inn Square has been instructed by FIFA to act for it in judicial proceedings for interim relief brought in the Brussels courts by, inter alia, the Malta based investments fund Doyen Sports, relating to the prohibition on third party ownership of players’ economic rights (TPO) introduced into FIFA’s Regulations on the status and transfer of players in January 2015.

The applicants’ main argument consisted in an alleged violation of EU competition law and the free movement of capital.

On 24 July 2015, the Tribunal de Première Instance held that the applicants had failed to show a prima facie case and dismissed the application.

On 10 March 2016, the Cour d’Appel rejected the appeal and has equally held that no prima facie case regarding the alleged breach of EU law was demonstrated by the appellants.

UEFA and the Belgian Football Association (URBSFA) were the other defendants. The International Federation of Professional Footballers (FIFPro) intervened on the side of the defendants.

Cases on the same matter are pending before the Brussels Tribunal de Commerce and the Paris Tribunal de Grande Instance. Complaints have also been lodged with the European Commission whose decision is awaited.
