Richard Clayton QC argues constitutional case in Turks and Caicos Court of Appeal

Richard Clayton QC has recently returned from arguing an 8 day case before the Court of Appeal in relation to the prosecution brought against the former Prime Minister, Cabinet members and other individuals who are accused of corruption charges. The case in R v Miscik and others raised two important issues: whether the security of tenure of Supreme Court judges of 2 to 3 years in Turks and Caicos breached the constitutional right to a hearing before an ‘independent court’ and whether an application to try the prosecution without a jury had to be decided on the criminal standard of proof. Judgment is awaited and the constitutional point will be argued before the Privy Council sometime in the next few months. The case has important constitutional implications in the Eastern Caribbean and attracted considerable interest.
